Probate records are court records that describe the distribution of a person’s estate after he or she dies. Information in the records may include the death date, names of heirs and guardians, relationships, residences, an inventory of the estate, and names of witnesses. Probate records in Italy are included in a notary’s official record. For more information, see the "[[Italy Notarial Records|Notarial Records]]" in this outline.

Probate records exist only in countries with Common Law. Therefore, Italy does not have probate records, but has what are called Declarations of succession (Dichiarazioni di Successione).

Declaration of succession records indicate the distribution of a person’s estate after he or she dies. Information in the records must include the death date, names of heirs and guardians, relationships, residences, and an inventory of the estate. A notary’s official record exists if the decedent died testate, otherwise, the Notary is not necessarily involved. For more information, see the Notarial Records in this outline.
